The Land and Environment Court of New South Wales was established on 1 September 1980. It’s purpose was to be a “one stop shop” for environmental, planning and land disputes which had previously been determined by a number of different courts.
The court hears matters relating to environmental, building, planning and development disputes in New South Wales.
The court has the exclusive jurisdiction to undertake merits review, judicial review, civil enforcement, criminal prosecution, criminal appeals and civil claims about planning, environmental, land, mining and other legislation.
The matters determined by the court fall into eight classes:
Class 1: Environmental, planning and protection appeals.
Class 2: Tree disputes and miscellaneous appeals.
Class 3: Valuation, compensation and Aboriginal land claim cases.
Class 4: Civil enforcement and judicial review of decisions under planning or environmental laws.
Class 5: Criminal proceedings for offences against planning or environmental laws.
Class 6 and 7: Criminal appeals against convictions and sentences for environmental offences by the Local Court.
Class 8: Mining matters.

ON 30 JUNE 1988, the High Court of Australia delivered Oceanic Sun Line Special Shipping Company Inc v Fay [1988] HCA 32; (1988) 165 CLR 197 (30 June 1988).

The court found that a contract of carriage was made in Australia at the time of payment and that terms and conditions printed on a ticket later issued in Greece had no effect and could not alter what was already agreed in Australia.
The court held that in a contract of carriage:
- a condition printed on a ticket has no effect to alter the contract if the ticket is issued after making the contract
- an exemption clause (excluding liability of loss) on a ticket has no effect unless the carrier does all that is reasonably necessary to bring the clause to the passenger’s notice.
The court also held that when a defendant applies for a stay or dismissal of proceedings on the grounds of forum non conveniens (forum not appropriate), it must persuade the local court that the plaintiff’s claim should be brought in another court because the local court is a clearly inappropriate forum to determine the dispute.

Where serious or grave allegations are made in a civil case, the court must, when making findings of fact, apply the civil standard of proof but, depending on the nature of the issue, give serious consideration as to whether or not it has reached the necessary degree of reasonable satisfaction or persuasion that the alleged facts are more likely than not to exist.
Per Dixon J at 362:
“… [R]easonable satisfaction is not a state of mind that is attained or established independently of the nature and consequence of the fact or facts to be proved. The seriousness of an allegation made, the inherent unlikelihood of an occurrence of a given description, or the gravity of the consequences flowing from a particular finding are considerations which must affect the answer to the question whether the issue has been proved to the reasonable satisfaction of the tribunal. In such matters ‘reasonable satisfaction’ should not be produced by inexact proofs, indefinite testimony, or indirect inferences. Everyone must feel that, when, for instance, the issue is on which of two dates an admitted occurrence took place, a satisfactory conclusion may be reached on materials of a kind that would not satisfy any sound and prudent judgment if the question was whether some act had been done involving grave moral delinquency. …”

The Act was introduced to remove doubts as to the validity of laws made in the British colonies. The Act provided that colonial legislatures were deemed to have full power to make laws in respect of their colonies, provided they are made in the correct manner and form and not repugnant to any laws of the United Kingdom that extended to the colony.

Chancery Amendment Act 1858 (UK) 1858 (“Lord Cairns’ Act “) | 28 June 1858
ON 28 JUNE 1858, the UK Parliament enacted the Chancery Amendment Act 1858 (UK), also known as the Lord Cairns’ Act 1858.
The Act allowed the English and Irish equity courts to award damages. Until then, equity courts were limited to granting injunctions and specific performance. The Act also allowed the equity courts to call juries.
