ON 19 SEPTEMBER 2014, the Federal Court of Australia delivered Essendon Football Club v Chief Executive Officer of the Australian Sports Anti-Doping Authority [2014] FCA 1019 (19 September 2014).

Justice Middleton dismissed the actions by Essendon Football Club and James Hird seeking declarations, injunctions and a permanent stay against the Australian Sports Anti-Doping Authority (ASADA).

State Government Insurance Commission v Trigwell [1979] HCA 40 | 19 September 1979

ON 19 SEPTEMBER 1979, the High Court of Australia delivered State Government Insurance Commission v Trigwell [1979] HCA 40; (1979) 142 CLR 617 (19 September 1979).

The High Court confirmed the English common law rule of Searle v Wallbank “that the owner or occupier of a property adjoining the highway is under no legal obligation to users of it so to keep and maintain his hedges, fences and gates as to prevent animals from straying on to it, and that he is not under any duty as between himself and users of it to take reasonable care to prevent any of his animals, not known to be dangerous, from straying on to it” (at 631).

Since this decision, State legislatures have passed laws to make farmers liable for the actions of their animals.

Apple Computer Inc v Microsoft Corporation 35 F.3d 1435 (9th Cir 1994) | 19 September 1994

ON 19 SEPTEMBER 1994, the United States Court of Appeals for the Ninth Circuit delivered Apple Computer Inc. v Microsoft Corporation, 35 F.3d 1435 (9th Cir 1994).

It was held that Microsoft’s Windows and Hewlett Packard’s New Wave graphic user interfaces (GUI) did not violate Apple’s copyright to the Apple Macintosh GUI.

Study into Age Discrimination in the Workplace

CANBERRA. Age Discrimination Commissioner Susan Ryan today announced that Roy Morgan Research has been hired to do a study into the prevalence of age discrimination in Australian workplaces.

The Commissioner expects an interim report end of the year and a full report released to the public by March next year.

Householders’ Asbestos Removal Scheme

Willoughby City Council is trialling a Householders’ Asbestos Removal Scheme, funded by the NSW Environment Protection Authority (EPA).

The waste levy and tip fees for the disposal of asbestos will be waived from 31 July 2014 for 12 months, or until 5,000 tonnes of asbestos is collected.

Asbestos must be removed by a council approved contractor.

Other partners to the program are Kogarah City Council, Rockdale City Council, Sutherland Shire Council and Hurstville City Council.
