Plessy v Ferguson 163 US 537 (1986)

ON THIS DAY in 1896, the US Supreme Court delivered Plessy v Ferguson 163 US 537 (1896).

The US Supreme Court applied the doctrine of “separate but equal” to uphold the constitutionality of state laws providing for racial segregation in the provision of public facilities.

The decision was overruled by the court in Brown v Board of Education on 17 May 1954.

Women granted the vote in South Australia

ON THIS DAY in 1895, the Constitution (Female Suffrage) Act 1895 (SA) granted South Australian women (except for aboriginal women) the right to vote.  SA was only the second jurisdiction in the world to do so following New Zealand (1893).

ON 17 MARCH 1893 the Supreme Court of NSW delivered Ex parte Ogden [1893] NSWLawRp 22; (1893) 14 LR (NSW) 86.  

Married women and aliens were considered to be under a disability that prevented them from voting in municipal elections.

Dred Scott v Sandford (“Dred Scott case”) 60 US 393 (1857)

ON 6 MARCH 1857, the US Supreme Court delivered Dred Scott v Sandford 60 US 393 (1857).

The US Supreme Court ruled that slaves African ancestry were not citizens under the US Constitution.

The decision caused outrage and was a significant event leading up to the election of Abraham Lincoln and the Civil War from 1861 to 1865.

Marbury v Madison 5 US 137 (1803)

ON 24 FEBRUARY 1803, the US Supreme Court delivered Marbury v Madison 5 US 137 (1803).

The Supreme Court of the United States held invalid legislation passed by Congress which purported to enlarge the original jurisdiction of the Supreme Court by authorising the issue of mandamus. The Court held that Congress had no power to give original jurisdiction to the Supreme Court in cases other than those described in Art III.

The decision is significant in that it sets the principle that the US Supreme Court has the ultimate power to review the validity of acts of Congress enacted in violation of the United States Constitution.
